我国生命伦理审查制度的法治化：现状、问题与出路

摘　要：

伦理审查制度最初形成于生物医学领域，并逐渐发展为适用于整个自然科学研究领域乃至社会科学研究领域的一项重要制度。我国也早于20 世纪末在医学治理实践中确立了伦理审查制度，并伴随着国家法治化进程的推进而逐渐将其升格为一项法律制度。目前，我国生命伦理审查制度的法治化无论在制度制定层面还是在制度实践层面都还存在一些需要直面并解决的问题。为此，需要进一步完善我国生命伦理审查立法，制定一部效力位阶更高、更权威的专门立法，并通过加强引导与教育来提高生命科技工作者对伦理审查的认知，以强化制度在实践中的实施。

The legalization of China’s life ethics review system: current situation, issues and solutions

Abstract:

The ethics review system was initially formed in the field of biomedicine and gradually developed into an important system applicable to the entire field of natural science research even to the field of social science research. Our country has also established the ethics review system in the practice of medical  governance long before the end of the 20th century, and gradually upgraded it into a legal system with the advancement of the national rule of law. At present, there are still some problems that need to be faced and solved in the legalization of life ethics review system in our country, whether at the level of system  formulation or at the level of system practice. In order to solve these problems, it is necessary to further improve the legislation of life ethics review in our country, formulate a higher legal effect and more authoritative special legislation, and improve the understanding of life science workers on ethics review through strengthening guidance education, so as to strengthen the implementation of the system in practice.
